Acceptable use/terms

All services must be paid in full before activation: you will have a 7 day grace period after the due date before your service is terminated. A full backup of your hard drive image will be kept for 90 days following your termination and will be irrecoverably deleted after you have downloaded the image twice (or you have clicked "remove backups" in the control panel). Your first month payment will be prorated. Billing dates start on the first of each monthly period.

These terms may change at any time. You will receive 30 day notification in the event of any changes. If the terms and conditions are modified and you do not wish to agree to them, you will have one week notice grandfathered in under the previous revision of the terms to terminate service.

We reserve the right to refuse service to any person at any time for any reason not prohibited by law. Any malicious activity originating from customer servers will result in immediate termination.

Cancellation

You can cancel your service at any time. You will receive a prorated refund based on the amount of time you have left on your contract. There is no minimum notice period for cancellations. If requested, we can assist you in finding a hosting provider more suited to your needs. The client/provider relationship goes both ways: we will make sure you leave on good terms and stay on good terms.

If you are terminated for abuse, there will be no backups or refunds provided.

If you submit a dispute or chargeback, expect no further replies to any messages sent, immediate termination of all services related to your account, referred to our legal counsel, and sent to collections. Work with us - if you want a refund, ask. Don't just think sending a chargeback is a good idea.

Sanctioned countries

We will not sell to customers physically located in the Balkans, Belarus, Burma, Cote d'Ivoire, Cuba, Democratic Republic of the Congo, Iran, Iraq, Republic of Liberia, Lebanon, North Korea, Somalia, Sudan, Syria, or Zimbabwe due to United States regulations and trade sanctions. We will drop anyone attempting to resell to someone in these countries, directly or indirectly.

Prohibited

If any are found, you are subject to immediate termination if they are found to be yours (we will work with you if you are a shared hosting provider, other host, or similar to the aforementioned).

IRC services are not permitted for resale or commercial use. Personal lightweight usage is fine.
Warez, copyrighted content, copyrighted music, movies, etc. except when used in accordance to fair use guidelines (e.g. very short clips, educational, etc)
Pirated software, key generators, anything similar
Anything illegal in the United States or worldwide
Any sites relating to theft, fraud, or cracking (hacking is defined as modification of hardware or software, not maliciousness)
Torrent files or trackers that include copyrighted content
Anything that assists in any of the above

Overages

Overages must be paid in full when bill is received. On negligible amounts such as under 512Kbps 95th percentile or under 150GB per-GB billing, we reserve the right to waive all overage charges and/or fees at our discretion.

Mailing

No bulk mail, no CAN-SPAM compliant mail, no pharmaceuticals, no Viagra, you get the point. We do not serve spammers. Newsletters and such for forums are fine and will be accomodated. If you really feel like sending very large quantities of mail, we recommend Sailthru for whitelisted, high-deliverability internet messaging.

Illegal content

You will not host any illegal content according to the laws of New York City, New York, or Boston, Massachusetts. You will not host any content that violates United States law. You will not receive a backup of your server in this case and will be subject to immediate termination without refund if you are the originator of the content. If your server has been compromised or you are reselling/providing hosting to others, we will work with you reasonably.

DMCA

Neutrino will process and act upon infringement notices sent to any e-mail address associated with Neutrino, including 'abuse', 'sales', and 'support'. DMCA notifications will be forwarded downstream for the end-user to act upon within 24 hours. Abuse of DMCA notification to take down content that is not yours or content you just plain dislike will result in counternotice(s), the ignoring of any messages from you, or legal action.

Liability

The limit for any claims against Neutrino will not exceed the total amount that the customer has paid in service fees for the life of the account. Neutrino is not responsible for lost profits due to downtime, any kind of damages, punitive damages, or any monetary compensation above the service level agreement.

These terms supersede all previous terms or policies.

Abuse provisions

If you abuse our staff in any way or form, you will be terminated immediately. A backup of your data will be provided for you. This includes using profanity, repeatedly bumping tickets to the top of the queue (reasonable is fine, we have seen 10+ replies in under two minutes on a low priority ticket), and other common sense behaviour.
